1206 West Louisiana Street
Project Media & Usage Agreement
This agreement outlines the expectations, permitted uses, and ownership of photography, video, interviews, audio recordings, documentary footage, and other media created by MAAE Media / Michael Lewis in connection with the property located at 1206 West Louisiana Street, McKinney, Texas.
This project is being produced on a pro bono basis. No photography, production, editing, or creative fees are being charged for the work described here.
The decision to provide these services without charge does not transfer ownership of the resulting media or place the work in the public domain. The scope, historical significance, and long-term value of this project make responsible control of the media especially important.
1. Purpose of the Project
The primary purpose of the media created for this project is to:
Document and tell the story of 1206 West Louisiana Street.
Create photography and video supporting the marketing and sale of the property.
Produce a short documentary-style film exploring the home's history, architecture, preservation, restoration, and the people connected to its story.
Preserve a visual record of the property at this point in its history.
The project may include architectural photography, detail photography, drone imagery, video, interviews, historical photographs or documents, narration, audio recordings, archival material, behind-the-scenes footage, and edited documentary content.
2. Copyright and Ownership
Unless specifically stated otherwise in writing, MAAE Media / Michael Lewis retains all copyrights and ownership rights to the original photography, video, audio recordings, interviews, edits, documentary footage, and other media created by MAAE Media for this project.
Providing copies of these files to another individual does not transfer copyright or ownership.
The media may not be sold, licensed, transferred, syndicated, donated, submitted for publication, or distributed to third parties except as specifically permitted by this agreement or with prior written authorization from MAAE Media.
3. Usage Rights Granted to Bob
Bob is granted a non-exclusive license to use the finished media for the marketing and sale of 1206 West Louisiana Street.
Permitted uses may include:
MLS and real estate listing platforms
Property marketing websites
Social media
Email marketing
Digital advertising
Printed property marketing materials
Presentations to prospective buyers
Brokerage or agent websites
Other reasonable promotional activity directly related to marketing or selling the property
These usage rights are granted specifically for the marketing of 1206 West Louisiana Street and do not transfer ownership of the media.
Bob may not sell, sublicense, transfer, or grant independent usage rights to another person or organization.
4. Copies Provided to Fred and Kathy
Fred and Kathy Telecky may receive copies of the completed photography and documentary film for their personal and archival use.
They are welcome to:
Keep and preserve the files
Share the media privately with family and friends
Display photographs privately
Maintain the documentary and photography as part of their personal history of the home
Providing these files does not transfer copyright or commercial distribution rights.
5. Third-Party Distribution
The photography, film, interviews, footage, or other media may not be provided to third parties for independent use, publication, reproduction, broadcast, archival publication, or distribution without prior permission from MAAE Media / Michael Lewis.
This includes, but is not limited to:
The City of McKinney
Historical societies or preservation organizations
Museums or archives
Newspapers
Television stations
Magazines
Online publications
Bloggers or content creators
Documentary producers
Other photographers or filmmakers
Real estate companies or agents not involved with the property's current marketing
Commercial organizations
Educational institutions
This restriction does not mean that these organizations are prohibited from using the material altogether.
Rather, any organization interested in publishing, displaying, broadcasting, archiving, or otherwise using the media should contact MAAE Media / Michael Lewis directly so the appropriate permission and usage terms can be established.
6. Historical and Editorial Opportunities
Because of the historical importance of the property, there may be future opportunities for the photography or documentary to appear in historical publications, exhibitions, news coverage, preservation materials, educational projects, or other editorial contexts.
MAAE Media reserves the right to evaluate these opportunities individually.
Permission may be granted at MAAE Media's discretion depending upon the organization, purpose, context, attribution, and intended use.
7. Editing and Modification
Finished photography and video should be presented substantially as delivered.
The media may not be materially altered, re-edited, filtered, digitally manipulated, cropped in a misleading manner, combined into another production, or modified in a way that changes the intended presentation of the work without permission.
Normal resizing, formatting, and reasonable cropping necessary for social media, MLS, websites, or advertising are permitted.
The documentary film may not be independently re-edited, shortened into a separate production, incorporated into another film, or used to create derivative productions without permission.
8. Interviews and Documentary Material
Interviews recorded for the documentary are being collected as part of a larger historical story.
Raw interview recordings, unused footage, alternate edits, production files, project files, and other source material are not automatically included with the final deliverables.
MAAE Media retains editorial discretion over how interviews and other recorded material are incorporated into the documentary.
Not every interview, statement, photograph, historical fact, or piece of footage collected during production is guaranteed to appear in the final film.
9. Creative and Editorial Control
MAAE Media retains creative and editorial control over the documentary and final media produced for the project.
Every reasonable effort will be made to portray the property, its history, its owners, its restoration, and the individuals involved accurately and respectfully.
Because this is a documentary-style project rather than commissioned advertising, the final film is intended to tell the story of the property rather than function solely as a traditional real estate marketing video.
10. MAAE Media Portfolio and Promotional Use
MAAE Media / Michael Lewis retains the right to display and use media created during this project for:
Portfolio purposes
MAAE Media websites
Social media
Professional presentations
Competitions or industry recognition
Behind-the-scenes or educational content
Promotion of photography, filmmaking, architectural, or documentary services
Discussion of the historical or creative process surrounding the project
Any such use will be handled in a manner consistent with the historical significance and character of the project.
11. No Transfer of Rights Through File Possession
Possession of a photograph, video, download link, USB drive, digital file, or other copy of the media does not constitute ownership of the copyright or permission to grant that media to another organization.
If someone requests copies of the media for purposes outside those specifically permitted above, they should be directed to MAAE Media / Michael Lewis.
12. Collaborative Intent
This project is being undertaken as a collaborative effort to document, preserve, and tell the story of an important McKinney property.
The intent of these guidelines is not to unnecessarily restrict the sharing of the home's story. Rather, they are intended to ensure that the photography, film, interviews, and historical materials created during the project remain accurately presented, properly attributed, and responsibly distributed.
MAAE Media is donating a substantial amount of photography, filming, editing, production, and creative work to this project. Retaining control over the resulting media allows the work to continue representing both the property and the individuals involved in a thoughtful and appropriate manner.
9. Participant Appearance, Voice & Likeness Release
Individuals who voluntarily participate in interviews, narration, or other recorded activities for this project may be asked to provide written authorization for the recording and use of their participation.
By signing an individual Participant Release, each participant authorizes MAAE Media / Michael Lewis to record, photograph, reproduce, edit, publish, and publicly display their name, image, likeness, voice, interview statements, and other recorded contributions in connection with the documentary and related project materials.
This authorization includes use in:
The completed documentary and subsequent versions
Trailers, previews, excerpts, and promotional materials
Real estate marketing directly related to the property
Websites, social media, and digital platforms
Historical, educational, editorial, and documentary presentations
MAAE Media's professional portfolio and promotional materials
Participation is voluntary and does not entitle participants to compensation, ownership of the completed media, or approval of the final production.
MAAE Media retains editorial discretion over the selection, arrangement, and presentation of recorded material, provided it is not knowingly presented in a materially false or misleading manner.
This authorization applies to the project's original release and future distribution, exhibition, and promotion. It does not authorize unrelated endorsements or uses that falsely imply a participant's support for another product, service, or organization.
Each identifiable interviewee, narrator, or other featured participant must execute their own release. The project agreement signed by the listing agent does not replace these individual permissions.
13. Historical Materials, Archival Content & Contributor Authorization
Throughout this project, MAAE Media may receive historical photographs, recordings, documents, written accounts, newspaper clippings, architectural drawings, personal photographs, and other archival materials from property owners, historians, family members, institutions, or other contributors.
Contributors who supply materials for possible inclusion in the documentary agree to identify, to the best of their knowledge, the origin, ownership, and any known restrictions associated with those materials.
Where a contributor owns or controls the necessary rights, they may authorize MAAE Media to:
Photograph, scan, digitize, or otherwise reproduce the supplied materials
Incorporate them into the documentary and related promotional content
Edit, crop, enhance, or adapt the materials as reasonably necessary for presentation
Display the materials in historical, educational, editorial, and promotional contexts related to the project
Preserve copies as part of MAAE Media's production archive
Contributing archival material does not transfer ownership or copyright of that material to MAAE Media.
Likewise, possession of an archival photograph or document does not necessarily establish copyright ownership or the authority to license its use.
Where ownership or usage rights cannot be established, MAAE Media reserves the right to obtain additional permission, limit use, or exclude the material.
Contributors retain ownership of their original materials unless separately agreed in writing. MAAE Media retains ownership of its own original photography, recordings, editing, and other original creative contributions, subject to any underlying third-party rights.
Whenever reasonably practical, appropriate historical sources and contributors will be credited.
Neither the provision of archival materials nor their inclusion in the documentary grants contributors ownership of, or independent distribution rights to, the completed film.
Acknowledgment
By signing below, I acknowledge that I have reviewed and understand the media ownership and usage expectations described above.
I understand that MAAE Media / Michael Lewis retains copyright ownership of media created for this project and that the usage rights granted to me do not include the right to sell, license, transfer, or independently distribute the media to third parties except as described above.
